Except for Blue Cross Blue Shield, private individual insurers are allowed to deny your application for insurance, based on a health problem, unless you are HIPAA eligible. Anthem and CareFirst Blue Cross Blue Shield companies are required to write an individual policy, no matter if you have a medical problem. It may be expensive because there are no limitations on the costs of premiums or on renewals. In the presence of a pre-existing condition, individual insurers are allowed to attach elimination riders; they can also impose exclusion periods for a maximum of 12 months. The specifications of a pre-existing condition are different for individual policies than for group ones. Pregnancy may be considered a pre-existing condition, but genetic information cannot. Your individual policy cannot be cancelled due to illness.
Group Health Insurance in Virginia (VA)
Virginia regulations governing group health insurance provide that qualified persons cannot be denied or charged more for group coverage if they have a medical problem. Due to life changes related to family or job loss, you may be eligible for special opportunities for group coverage. Your new employer can wait to offer group coverage and a new HMO can impose an affiliation period. A group insurance company is allowed to look back at your medical history for the six months prior to coverage. If you have a pre-existing condition, they can exclude coverage for a maximum of 12 months. There are special rules about late enrollment. If you have maintained your coverage continuously, with no lapses longer than 63 days, you can receive creditable coverage for the exclusion period.
