Individual Health Insurance in New Mexico (NM)
Individual health insurance companies are allowed to refuse insurance if you have a medical condition. If you have a pre-existing condition, insurers are allowed to impose elimination riders on policies. They are also allowed to impose exclusion periods for no longer than six months at the beginning of new individual coverage. According to the New Mexico Public Regulation Commission, pregnancy cannot be considered a pre-existing condition. Genetic information is not considered pre-existing either. The cost of individual premiums cannot be changed because of changes in health status, but there are no limits to increases otherwise. Your policy cannot be cancelled if you become ill.
Group Health Insurance in New Mexico (NM)
New Mexico regulations provide that qualified individuals applying for group health insurance cannot be refused or charged more for a policy because of a health problem. There are several life changes relating to family problems, children, marriage, and job loss which may affect your opportunities for group health coverage. A new employer may require a waiting period before offering group health coverage. Pre-existing conditions are set by the new insurance company which has the right to look back at your medical history for the six months prior to insurance coverage. It can then apply an exclusion period of no more than six months for fully insured groups on the pre-existing condition, before providing coverage. If you have maintained continuous coverage, with no lapses of more than 63 days, you are entitled to continuous coverage.
Small Business Health Insurance in New Mexico (NM)
Small businesses with two to 50 employees cannot be refused small group health coverage, nor can the insurance be cancelled because of illness in your employee group. New Mexico does require that you be offered several insurance plans. With certain limits, the cost of your premium can be based on the health of your group. Annual increases have certain limits. You may buy your group coverage through the New Mexico Health Insurance Alliance also.
Self-Employed Health Insurance in New Mexico (NM)
The self-employed are not allowed to purchase group health insurance, with one exception: if you and at least one other family member are applying together for small group coverage, you can buy it from the New Mexico Health Insurance Alliance. Because people and businesses join professional associations which offer group health insurance to its members, it is recommended you check with the New Mexico Insurance Division for regulations.
