Individual Health Insurance in Maryland (MD)

Individual health insurance regulations do not require insurance companies to accept you in the presence of a health problem. Except for HMOs, any pre-existing condition you have may be excluded from coverage by an elimination rider. In addition, insurance companies have the right to search your medical records in the prior seven years for pre-existing conditions if you make a claim in the first 24 months of coverage. In Maryland, pregnancy is considered a pre-existing condition, although genetic information is not. There is no credit for continuous coverage for pre-existing conditions in individual policies. There are no limits on individual health premiums and no limits on the cost of policy renewals. Cancellation of insurance is prohibited because of illness.

Group Health Insurance in Maryland (MD)

Group health insurance in Maryland cannot be denied because of a health problem if you are qualified for group coverage. Certain life changes dealing with children, marriage, death, and loss of a job can give you additional opportunities for group health coverage. Maryland law also provides special protections for guardianships and dependent grandchildren by requiring their inclusion in fully insured group plans. A new employer may wait a short time before offering group coverage. New insurance companies may check your medical records in the prior six months before policy acceptance for pre-existing conditions, if you make a claim in your first year of coverage. There are limitations on the length of exclusion periods for any pre-existing conditions that vary according to your type of group plan. HMOs and small group health plans are not allowed to set exclusion periods. If you have had continuous coverage of health insurance, you must be given credit for exclusion periods from other types of health plans.


Small Business Health Insurance in Maryland (MD)

Small businesses cannot be turned down and cannot be charged more for group coverage because of the health of a member of the group. A standard plan is the only policy that can be offered to these small businesses with only two to 50 employees.

Self-Employed Health Insurance in Maryland (MD)

The self-employed can buy small group coverage in December of each year, during open enrollment. If you wish to buy at another time of the year, you must follow the rules for individual health policies. Since you can be a group of one, the premium cannot be based on your health position; however, the premium can increase with age.
